You should read this user terms carefully before downloading the Niftie App and/or using the Niftie Services how to use the service and the App
Niftie is a ride sharing facilitator. It connects you with third party transport providers, to get people to events quicker, cheaper and more easily than ever before (think of it like ‘ride sharing’, except your all going to the same place and excited about the same event!).
In essence, the Service joins you to a grouped request for transport. The cost of the Service include the cost of the transport, meaning you don’t have to worry about any pesky payments to drivers on the day; it’s all taken care of.
Of course, each third party transport provider may impose its own rules and regulations about the terms of your commute but these are all pretty standard. In any event, we’ll try to get you a copy of any transport guidelines beforehand, once a Service has been confirmed.
Confirmation of your trip
Each transport deal which comprise the Service is only activated once 10 people (“Base Participants”) are registered for that Service.
Each Service will be confirmed or cancelled no later than 48 hours before the scheduled departure of that Service. Niftie reserves the right to vary that confirmation or cancellation time, but in doing so will endeavour to give users time to make alternate arrangements in the event of cancellation of a Service.
Similarly, you can cancel a booking prior to the scheduled event provided that the event has not already been confirmed by Niftie. If it has been confirmed, then your spot has been secured.
If at least the Base Participants are not reached and the Service is cancelled, the money you paid for that Service will be refunded to you. Niftie will endeavour to effect any refunds within 72 hours of an Service’s cancellation. Sometimes this may take a little longer, depending on your bank.
If you cancel a booking prior to a Service being confirmed, then you will receive a full refund (minus a small admin fee). If you cancel a booking after a Service has been confirmed, we unfortunately won’t be able to refund you for that Service.
Niftie will charge you for the transportation services booked at the time of your booking.
You agree that you will pay for all transportation services you purchase through your use of the Niftie site or app, and that Niftie may charge your credit card account as provided by you when registering for the specific transport service.
Niftie uses a third-party payment processor (the “Payment Processor”) to link your credit card account to the Service. The processing of payments or credits, as applicable, in connection with your use of the Service will be subject to the terms, conditions and privacy policies of the Payment Processor (in this case, PayPal) and your credit card issuer in addition to these T&Cs.
You agree that Niftie is not responsible for any errors by the Payment Processor. In connection with your use of the Service, Niftie will obtain certain transaction details, which Niftie will use solely in accordance with its Privacy and Cookie Notice.
By accepting these User Terms and using the Service, you agree that you shall defend, indemnify and hold Niftie, its affiliates, its licensors, and each of its officers, directors, other users, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including lawyers’ fees and costs) arising out of or in connection with:
- your violation or breach of any term of these T&Cs or any applicable law or regulation, whether or not referenced herein;
- your violation of any rights of any third party, including transportation providers arranged through the Service; or
- your use or misuse of the Service.
The information, recommendations and/or services provided to you on or through the Service is for general information purposes only and does not constitute advice. Niftie will reasonably keep its website and its contents correct and up to date although does not guarantee that (the contents of) the its website are free of errors, defects, malware and viruses or that the website and/or Application are correct, up to date and accurate.
Nifite shall not be liable for any damages resulting from the use of (or inability to use) the Niftie website, including damages caused by malware, viruses or any incorrectness or incompleteness of the Information or the website or Application, unless such damage is the result of any wilful misconduct or from gross negligence on the part of Niftie.
Niftie shall further not be liable for damages resulting from the use of (or the inability to use) electronic means of communication with the website or the Application, including – but not limited to – damages resulting from failure or delay in delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and transmission of viruses.
The quality of the transportation services requested through the use of the Service is entirely the responsibility of the third party transportation providers who ultimately provide such transportation services to you. Niftie under no circumstance accepts liability in connection with and/or arising from the transportation services provided by any transportation provider booked through the Niftie platform nor accepts liability for any acts, actions, behaviour, conduct, and/or negligence on the part of the third party transportation provider. Although Niftie is keen to hear about your experience in order to continually improve the businesses with which it works, any complaints about the transportation services provided by the transportation provider should therefore be submitted to that transportation provider.
Privacy and Cookie Notice
Niftie collects and processes the personal data of the visitors of the Niftie website according to the Privacy and Cookie Notice. Niftie will also keep up updated on its progress and on future transport opportunities, unless of course you opt out of these emails.
